Prosecution and Defense of Corporate, Construction and Employment Related Claims

During 2001, the Firm represented JMC Construction Company, Inc. in a complex construction litigation matter arising from work performed at Carswell Air Force Base, at Fort Worth, Texas. A three person arbitration panel ultimately made an arbitration award in favor of JMC that was subsequently reduced to Judgment in Federal Court for amounts in excess of $260,000.00.

During 1998, the Firm represented JMC Construction Company and various corporate officers against multiple claims, including breach of partnership agreement, in which damages in excess of one million dollars were sought. (JMC Construction v. Stenger), in the 191st District Court of Dallas County) A take nothing judgment was entered in favor of JMC Construction and its officers.

RTC v. Sands, 863 F.Supp. 365 (N.D. Tex. 1994). Mr. Emerson was retained by the RTC to prosecute negligence claims seeking damages in excess of one hundred million dollars, against various officers and directors of the former Southwest Savings and Loan Association.
